Product Compliance

Products sold in Canada, USA or the EU must comply with regulations such as WHMIS, OSHA and EU directives/CLP. This can be in the form of Safety Data Sheets along with Labeling/Packaging details. Dell Tech offers data sheet authoring services, label reviews and consulting on label specifications.

  • MSDS & SDS Preparation (Canada, USA, EU)

  • Material Safety Data Sheets (MSDS) contain specific information related to the chemicals within a product. WHMIS requires that an MSDS be available for controlled products.
  • The USA Occupational Safety & Health Administration (OSHA) Hazard Communication Standard (HCS) also requires that MSDSs are readily available.
  • In the EU, Safety Data Sheets (SDS) are required for hazardous preparations according to the Dangerous Substances Directive (67/548/EEC) and the Dangerous Products Directive (1999/45/EC).
  • SDS required for hazardous substances are required according to the Classification, Labeling and Packaging Regulations (CLP) and Directive 67/548/EEC
  • Dell Tech authors MSDS/SDS to meet the various Canadian/USA/EU requirements, including Transportation of Dangerous Goods (TDG), Department of Transportation (DOT) shipping classification, and compliance with CEPA and HMIS/NFPA ratings.
  • Canadian and USA Consumer Labeling (CCCR, CPSC)
  • The Consumer Chemicals and Containers Regulations (CCCR 2001) establish categories and criteria for labeling and packaging required for products sold in Canada.
  • The USA Consumer Product Safety Commission (CPSC) regulates the labeling of hazardous household products in accordance with the Federal Hazardous Substances Act (FHSA) and Poison Prevention Packaging Act (PPPA).
  • Compliance requires very specific label elements, including contrast, print type, legibility, durability, location and order.
  • Canadian Supplier and Workplace Labeling (WHMIS)
  • The Workplace Hazardous Materials Information System (WHMIS) is used to provide Canadian workers with information on materials used within their workplace.
  • WHMIS Supplier labels include hazard symbols, and very specific design, format and language requirements.
  • WHMIS Workplace labels also apply to controlled products that are produced and used in the workplace, transferred from one container to another within the workplace and when supplier labels are lost, defaced or illegible. Workplace labels include the product identifier, safe handling information and confirmation that an MSDS is available.
  • Trade Secret Applications (HMIRC)
  • The Canadian Hazardous Materials Information Review Commission (HMIRC) registration is required to protect confidential business information (CBI), such as the specific chemical identity, weight and/or percentage of any trade-secret hazardous ingredients used in product.
  • A registry number must appear on the Safety Data Sheet once granted by HMIRC.

Kirsten has an Honors B.Sc. in Zoology from the University of Western Ontario. Since 1999, when she joined Dell Tech, she has also acquired several professional certificates in the field of hazard communication. She has been supervising our Product Safety group which includes authoring Material Safety Data Sheets and product label reviews requiring her in-depth familiarity with Transportation, ANSI, OSHA and WHMIS regulations and how they all relate to non-registered products as well as to PCP, DIN, NHP, Cosmetic and CFIA registered products.
